1. Find out what policies exist to overturn the determination that it was no fault, probably with your insurance carrier first. Find out if there are any policies to get an adjuster to review the situation. They benefit from it not being your fault at all. If they know you think it was actually the driver's fault, they may put someone on the case to help prevent them from having to spend money covering your expenses.

 

Getting rear-ended is almost 100% the hitter's fault. You are legally responsible for the direction you are going and the speed at which you are going.

 

2. Talk to a lawyer. You don't have to sue. Discuss to determine if you even have a case. This is likely worth some consulting dolalrs here to put your mind at ease if nothing else. Start with a family or friend in the legal profession first, if possible.

 

3. Unless you sue people all the time, there is no way looking into legal resolutions label you as "sue-happy". Also, how much money are you willing to spend on a situation just to continue to appear "nice"? There is nice, and there is taken advantage of. Confirm where you are on this, for real. Nobody thinks the guy dropping hundreds of dollars on something that is not his fault is "nice". They are called naive.

I was asking Scraps here his thoughts on us having to shell out cash for this rental plus the deductable, and why we're paying for it if it wasn't our fault.

 

I think talking to a lawyer is not a bad thing to do and I think I will do that - first things first though, I want to see what our insurance company comes back with as far as a settlement for our car. They could have already done this wrangling on our behalf with the semi's insurance company, however i have this feeling it wont be all we need to cover our expenses.

I have an accord right now and it's like a 2002 or something? I can't remember but it's wicked safe and I drive like I have a stick up my ass and am i need of serious hospital care. So I figure if it can handle me driving it and still get good gas milage it's a pretty safe car. Also no white people have crashed into me when I have my windows down bumpin those jungle beats. So I'm guessing it has like +10 to white stealth. Not that you guys need that, but I just thought I'd put it out there.
