Yea... "You should have known better" law suits typically only get any traction when someone dies.

Yea... that's messed up.

 

Yes the outage sucked.

 

Should service have been better? Yes.

 

Are people paying for a service they didn't receive? Yes

 

 

Is the approximate $1 a week you pay for XBOX live service in any way worth $5 million in damages to 3 customers?

I doubt they will get much, maybe some money for the days Live was out. If it's a pay service and if not, then they'll have to probably show some sort of reliance and detriment due to their reliance on a promise of service?

 

I also don't understand the $5 mill figure or where it came from, usually judges don't randomly give out money because they know a lot more law suits of that caliber will appear on their docket and...judges don't want to do any extra work!

not trying to defend this ridiculous law suit but just as a clarification:

 

its a class action suit; i.e., 5 million dollars is a figure entitled to compensate all xbox live users who were "harmed" during the outage. the 3 people who filed the suit are just named plaintiffs for the paperwork.

 

even so, a 5 million dollar suit wouldnt net people jack. as of november, xbox live had roughly 8 million users...giving every one 63 cents if the suit was to win. *woopty doo*

 

then again, the lawsuit is more of a statement by some angry customers about their perceived injury from the servers being down.

 

anyways, its a stupid idea.....but 3 people wont be getting 1.6 million each :P

Most of the reports are saying it was because of an influx in new users, however theres the rumor of a possible DoS attack on Passport\Live authentication that basically screwed it all up for Live since thats how everyone gets authenticated.
