Find out if there are any policies to get an adjuster to review the situation. They benefit from it not being your fault at all. If they know you think it was actually the driver's fault, they may put someone on the case to help prevent them from having to spend money covering your expenses. Getting rear-ended is almost 100% the hitter's fault. You are legally responsible for the direction you are going and the speed at which you are going. 2. Talk to a lawyer. You don't have to sue. Discuss to determine if you even have a case. This is likely worth some consulting dolalrs here to put your mind at ease if nothing else. Start with a family or friend in the legal profession first, if possible. 3. Unless you sue people all the time, there is no way looking into legal resolutions label you as "sue-happy". Also, how much money are you willing to spend on a situation just to continue to appear "nice"? There is nice, and there is taken advantage of. Confirm where you are on this, for real. Nobody thinks the guy dropping hundreds of dollars on something that is not his fault is "nice". They are called naive. 4. Crush Haniel in your iron grasp. 5. Do a barrel roll. 6.
